    A German court on Tuesday sided with Apple and granted the company a preliminary injunction which blocks the sale of the Samsung Galaxy Tab 10.1 in the European Union, excluding the Netherlands. But according to Nicole Scott of Netbook News, the patent could essential block ALL tablets, irrespective of operating system or maker.

    Look at the damn patent!

    Apple is definitely sue happy lately. I think that they need to just throw this case out and let the competition continue. They can’t be allowed to get rid of competition because they share a similar shape. That’s ridiculous. Another reason why I hate Apple and all of their iCrap.

    Seriously!? This is Apple paranoia… if they can’t protect their designs then they’re scared that competition will eventually clobber them.

    This makes no sense whatsoever. It’s like saying no other cars can be built because Ford has a patent on the first car built and subsequently after that no other cars can come into the market to drive competition and innovation.

    By letting this stand it creates a precedent of design monopoly that can impact a whole industry.

    How much did Apple pay off to this judge????

    For one, there was a great This American Life episode on patent reform a couple weeks ago, very interesting. Basically a joke right now.

    Second, here is the history of tablets. I’d be shocked if there is a single thing that Apple can truly claim credit for.

    considering the fact that Steve Jobs stated negative comments on the idea of the 7 inch form factor, I would think that RIM, and other manufacturers of 7 inch tabs, could argue that they did not intend the patent to cover that size. Unless they had sizes attached to their patent application.

    I think it is crazy that Apple is expecting that they should have patent rights over all other tabs (perhaps), when they are using laptop/desktop form factors all these years. andthey weren’t the first to do so.

    I hope that there is some sanity developed through these various patent suits!

    That wiki link just makes everything Apple is suing about a non factor. They didn’t “invent” the tablet so what the hell are they talking about?
