MMS Compared to Limewire – Wireless Carriers Are Illegal File Sharing Networks

Chalk this up to the craziest mobile lawsuit of the month. Techdirt caught wind of a lawsuit involving all the big US mobile carriers including AT&T, Verizon, Sprint, & T-Mobile. The company Luvdarts is accusing these carriers of being illegal file sharing network and compares them to Limewire and Gnutella. Good stuff right?

The company, Luvdarts, created MMS content that was then forwarded by recipients illegally to other people over these carriers MMS networks. The carriers made money off this illegal forwarding of Luvdarts MMS content. They claim that wireless carriers are not covered by the DMCA safe harbor protections as service providers (which is a crock) and are suing for 9,999-100,000 counts of infringement at $150,000 per infringement. Crazy enough yet?


I guess next we will see email providers like Gmail getting sued for sharing files… 🙂
